£30,000 award for injuries caused by tripping at work

Accident caused acceleration of degenerative changes

Vivienne Bradford*

Mrs Vivienne Bradford, 51, was a well-respected employee at the factory where she had worked for over ten years. One day at work she stumbled on a raised lip of flooring and jarred her back. After a period off work she returned to the factory, but was troubled by persistent, debilitating back pain. She managed to struggle on at work for over a year but eventually recognized that she could no longer cope with her job on a full-time basis.

With the permission of her employers she cut her hours down from five to three days a week.

The consequence was that she was losing nearly £3,000 a year against what she had been earning before the accident.

Levenes pursued her claim and obtained medical evidence to show that, although Mrs Bradford had degenerative changes in her back prior to the accident, the accident had still had the effect of bringing symptoms of pain and stiffness forward by a period of five to ten years.

Proceedings were issued and Mrs Bradford accepted an offer of  £30,000 in settlement of her claim, with her legal costs paid in addition by the defendants.
