£55,000 settlement for accident on the German Autobahn

Claim succeeds after several other law firms had turned it down

Mrs Agnieska Kaminska* had almost given up the idea of getting compensation after several law firms turned her case down before she came to Levenes. She is now celebrating after receiving £55,000 in an out of court settlement. Her accident occurred when she was being driven by a friend on the autobahn in Germany. Her friend lost control of the vehicle and crashed into a barrier. No other vehicle was involved. She suffered a fractured arm. The arm injury was nasty because the fracture took a long time to heal. She needed two operations on her arm and as she was pregnant it was not possible to operate for many months. Her ability to work was hampered and she was left with some permanent restriction in the use of her arm. She also suffered a great deal of anxiety and lost confidence always fearing that she would be involved in another accident.
 
Why then, did other law firms not take on her case? The fact that the accident happened in Germany might have put them off. The truth is that if you are injured in a road accident anywhere within the European Union you can make a claim in the country where you live. Furthermore, the Defendant was her friend who also lived in England and had English insurance, so making a claim was no problem.
 
Levenes acted on a no win no fee basis. The claim was settled for £55,000 and the insurance company also agreed costs.
 
Mrs Kaminska was represented by Partner, Tim Beasley assisted by Paralegal Ewa Kosim. Tim is a particular expert on claims that involve accidents abroad.
 
Tim commenting on the case said "It is particularly pleasing that Mrs X did not give up after other law firms turned her down or she would not have received the compensation she deserved. It is quite shocking how much ignorance there is out there. If you have an accident abroad, it is always worthwhile getting advice as even if the accident happened abroad, you may be able to make a claim in England. The rules for accidents at work are slightly different, but even if you were working abroad when your accident happened, if your employer is English you should consider claiming in England where damages may well be higher than in other European countries"

I had never made a claim before so I was worried about what would be involved but I need not have been. I was on a "no win no fee" agreement and did not have to pay anything.
