Phil Wood was out on his motorcycle one bright July morning.  All was going well. Phil rounded a fairly tight left hand bend. He slowed right down to take the bend and had just started to pick up speed when a car driver coming the other way attempted to turn across Phil's path into an entrance about 50 metres beyond the bend. There was nothing Phil could do to avoid the collision. Phil and bike parted company, with Phil ending up in a ditch.  He was taken to hospital by ambulance where he was found to have fractures of both wrists and his pelvis and femur.

 

After surgery and a lengthy period on crutches, Phil was able to return to work. He required further surgery a year later for the removal of the metal that had been used to stabilize his fractures.

 

Although Phil made a very good recovery, he does still have some back ache but he was able to get back to going to the gym. Sadly for Phil, he promised his girlfriend that he would give up biking and he never did get back on his bike.

 

Phil instructed Tim Beasley of Levenes Birmingham Office to pursue his injuries. At first, the insurers for the car driver denied liability but the evidence from the Police report clearly showed that the car driver was to blame and the insurers admitted liability. The insurers then made interim payments for Phil's bike, helmet and leathers and for medical treatment.

 

After the medical evidence was finalised it was possible to settle the claim. Phil did not have to go to court. The insurers paid £23,500 in total for his injuries, treatment, bike, leathers and helmet. Phil did not lose any earnings as his employers paid him in full when he was off work. Phil's legal costs were covered by a Conditional Fee Agreement - 'no win no fee'. On the settlement of the claim, the insurers paid all his legal costs in full and Phil got to keep his £23,500 settlement in full.

 

Commenting after the settlement Phil said 'I was very pleased with the settlement which was more than I was expecting. Tim did a great job of making sure that I got the best possible settlement. '
