£100,000 settlement for wrist injury to lorry driverA Polish lorry driver has received a settlement for injuries and financial losses suffered in an accident at work.
Jarek Lemancyk was working as a lorry driver delivering to supermarkets across the Midlands. His job involved making multiple deliveries of goods on pallets. On Christmas Eve he was attempting to unload a pallet. The pallet had been badly loaded at the warehouse so that when he attempted to move it, the boxes fell off the pallet. Jumping back to avoid being hit by a box, Jarek fell and injured his wrist.
Jarek suffered a bad wrist injury. He had to have an operation on his wrist and he was off work for months. It was a struggle to survive and he returned to Poland for a while. However, Levenes were able to obtain an interim payment of £10,000 and Jarek was able to come back to work. Sadly, his injury left him with permanent problems and he could not return to work as a driver. He suffered a loss of earnings as he was not able to earn as much when he went back to work.
Following full medical assessment of the injuries and also an assessment to see if he would be able to drive again, a negotiated settlement of the claim for £100,000 was agreed.
Ewa Kosim of Levenes Polish team in Birmingham said: "It was a good result for our client in this case. We were very pleased that it was possible to cooperate with the insurance company of Jarek's employer to find a way of getting him back to work. The money will help Jarek but actually being back at work was very important for him too." Jarek said: "I am very pleased with the settlement and I would like to thank Ewa Kosim and Tim Beasley for their help with my case." |
