Settlement for Warehouse Worker

£7,000 settlement agreed after LLOP (Low Level Order Picker) crash

Katarzyna Milbergrova came over to England from the Czech Republic to find work. She got a job through an agency working at a Tesco warehouse. The warehouse was run by DHL Exell. 

One day she was riding on a LLOP (low level order picker) which is a motorized trolley used for moving pallets around the warehouse. The floor of the warehouse was badly maintained and the LLOP was difficult to control. Rubbish was allowed to accumulate on the floor. The floor was made up of sections of concrete. There was a gap between the sections. When the wheels of the LLOP ran over the gap in the floor the wheel jammed. Katarzyna was unable to control the LLOP and crashed into a barrier. She was knocked to the ground and the LLOP landed on her foot. She suffered a fractured bone in her foot and was off work for several months. 
 
Katarzyna instructed Levenes solicitors to pursue her claim for her. She signed a Conditional Fee Agreement which meant that she would not have to pay any legal costs, win or lose. 
 
We were able to get evidence from colleagues to show that there had been similar accidents before and that the floor was defective and that the LLOPs were difficult to control. Management had not taken action to ensure that the floor of the warehouse was properly maintained. 
 
DHL did not want the case to go to trial and so they settled the claim. Katarzyna will receive £7,000 under the terms of the settlement which will compensate her for her injuries and loss of earnings. Luckily, she made a good recovery her accident and is now able to get on with her life.
