We understand the importance of obtaining the right support and educational setting for children with Special Educational Needs. This can be a stressful and difficult process, often involving proceedings in the Special Educational Needs and Disability section of the First-tier Tribunal (SEND) or SENTW in Wales, The Upper Tribunal or the High Court. We can guide you through that process, ensuring that your case is presented as strongly as possible at whatever stage it is being considered.

We regularly act for parents in relation to all types of appeal to SEND, including:

  • Appeals against a refusal to carry out a statutory assessment of a child’s needs;
  • Appeals against a refusal to make a statement of special educational needs following an assessment;
  • Appeals about the contents of statements;
  • Appeals against the cessation of statements.

We have considerable experience in bringing appeals for placements in mainstream and special schools, independent schools and have developed an expertise in appeals for provision outside of school (such as home-based ABA programmes).

We also act in Upper Tribunal appeals against SEND decisions where parents have been unsuccessful or where a Local Authority is seeking to appeal a Tribunal decision.

Where a Local Authority is not arranging the provision in your child’s statement we can advise you and where necessary bring proceedings in the High Court to compel the Local Authority to arrange this provision and comply with its obligation to your child.
