Ex-nightclub owner fined £24,000The former owner of a nightclub where a customer severed an artery on broken tiles and was left needing a six-hour operation has been ordered to pay £27,500 for failing to report the incident.
A member of the public had fallen in the basement toilets of the nightclub, slashing his wrist on tiles in the wall and severing an artery, nerves and tendons, Bristol City Council reported.
Mr Cam Mu, who owned Mu Mu's nightclub in Bristol, had been instructed to report the injury to health and safety officers but failed to so. The club had already been shut in March last year after visits from health and safety staff.
Mr Mu pleaded guilty to two breaches of section 3(1) of the Health and Safety at Work etc Act 1974, and breaching Regulation 3 of the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995.
He was fined £24,000 with £3,500 costs and disqualified as a company director.
Health and safety officers had visited Mu Mu's on February 14, 2008, and served a prohibition notice after finding bare live wires in public places, broken windows, mirrors and light fittings, gas cylinders stored in the basement, rubbish blocking exit routes and dirty, dilapidated toilets with damaged wall tiles.
They also sent a letter listing all the defects requiring urgent attention and later served two Improvement Notices in relation to poor safety management at the club.
