Pair fined over digger accidentTwo brothers who run a building company in East Yorkshire have been fined over an incident in which a construction worker was run over by a digger.
Bricklayer Andrew Trezise, 58, from Pocklington, suffered a broken pelvis and serious leg injuries in the incident at the May Cottage construction site in Seaton Ross in July last year.
Beverley Magistrates' Court heard Bryan Kendra, of L&S Kendra & Sons, was reversing the 360 degree excavator digger when it hit Mr Trezise.
He pleaded guilty to breaching health and safety laws and was fined £9,000. He was ordered to pay costs of £2,500.
His brother, Christopher Kendra, was also fined £9,000 and told to pay £2,500 costs.
A Health and Safety Executive (HSE) investigation found that there were no markings to indicate where the digger was working, to ensure that it was separated from pedestrian movements on site. A reversing assistant had not been deployed to oversee reversing manoeuvres for the digger prior to the incident.
After the hearing HSE Inspector Geoff Clark said: "It is essential that steps are taken to segregate moving machinery, such as diggers, from other people on site."
