Firm fined after employee loses armA Warwickshire construction company has been ordered to pay more than £8,000 after an incident in which an employee lost his arm.
An employee of Morgan Est plc, of Corporation Street, Rugby, lost his right arm when he came into contact with a rotating screw conveyor on a newly-installed piece of equipment at Neiley Waste Treatment Works, New Mill Road, Holmfirth near Huddersfield.
Morgan Est plc was contracted by Yorkshire Water to refurbish the waste water treatment works, but an investigation by the Health and Safety Executive (HSE) found a fixed guard on the screw conveyor had been removed so sludge in the conveyor could be cleared.
The court heard that blockages had occurred in the past, but the machine had been isolated before work was carried out. The firm accepted it had failed to undertake a sufficient risk assessment for the clearing of blockages.
The firm pleaded guilty to breaching Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998 and regulation 3(1) of the Management of Health and Safety at Work Regulations 1999 at Huddersfield Magistrates Court. Morgan Est plc was fined £6,000 and ordered to pay £2,163 costs.
