£200,000 fine over scrap yard death

The death of a man killed in a scrap metal yard when a crushed car fell on top of him has seen the firm that runs the site fined £200,000.

Sims Group UK Ltd, of Long Marston, Stratford upon Avon, was prosecuted by the Health and Safety Executive (HSE) after truck driver Adrian Turner was killed when he was struck by a metal bale weighing one-and-a-half tons.

On April 28 last year, 50-year-old Mr Turner, who was from Wolverhampton, was delivering scrap to the site. He was directed to deliver his load to the metal shredder area of the yard.

Mr Turner left his cab and was opening the rear doors to his trailer when the one-and-a-half ton metal bale on the scrap pile came loose and rolled 20ft straight down on to Mr Turner.

He had not received any site safety induction from Sims UK Ltd and was following instructions given by Sims operatives when he was killed.

Sims Group UK Ltd, pleaded guilty to a charge under Section 3(1) of the Health and Safety at Work etc Act 1974, and at Cardiff Crown Court the company was fined £200,000 and ordered to pay £57,700 costs.

HSE inspector Sarah Baldwin-Jones said: "Mr Turner was struck from behind by the metal bale u002D a crushed motor vehicle u002D weighing some one and a half tons. Unfortunately, death or serious injury was an inevitable consequence."
