Late cyclist's family get £337,000

The family of a cyclist killed in a road accident has been awarded £337,500 in High Court damages after it was ruled that a skip lorry driver did not properly adjust his mirrors when turning, dragging the man under his wheels.

Ninian Donald, 34, was killed when lorry driver Bernard Madden had not adjusted his mirrors correctly to make double sure that it was safe to turn left across the inside lane at traffic lights.

Set builder Mr Donald, of Graham Road, Hackney, was killed instantly in the incident in May 2007 at the Kingsland Road and Whiston Road junction in Hackney, east London.

He leaves behind his partner 46-year-old TV and film art director Kate Evenden and daughter Rosie, who will be five in September.

Their counsel, Simon Michael, told Judge Simon Brown QC that a settlement had been agreed on the basis that the insurers of lorry driver Madden were 75% liable for the accident.

Mr Donald was judged to be 25% to blame as he moved on to the pavement out of the cycle and bus lane to avoid a stationary bus and rejoined the road in such a way that he could not see the lorry's indicators.

The judge, sitting in London, approved the settlement.
