Is your organisation facing a downturn? Do you need to reduce staff costs? Are you preparing for redundancies, restructuring/reorganisation, a merger or transfer of services or staff?

Employers have a number of important legal obligations in these situations.

It is often forgotten that redundancy is a form of dismissal and therefore care is required as if organisations get it wrong claims of wrongful and unfair dismissal can result as well as other types of claim.

Workers

We can review your redundancy procedures; advise you on voluntary and compulsory redundancies, selection criteria, individual and collective consultation and the duties to offer suitable alternative employment and allow reasonable time off to seek work; ensure that you give your employees the correct notice and make the correct redundancy payments in the most tax effiecient way possible; and represent you in the event of a claim being made.

Even where redundancies are not involved restructuring/reorganisation often involves Employment law issues, for example changes to employee's roles, terms and conditions of employment or work location. Take expert advice to ensure you don't end up with a breach of contract, constructive dismissal or discrimination claim.

Mergers and transfers of services or staff often involve the Transfer of Undertakings Protection of Employment Regulations, commonly known as TUPE. Failure to understand the impact of these regulations at the time of merger or transfer can have significant implications later on. We can advise you at all stages of the process and ensure your organisation is protected, now and in the future.
