Levenes have settled the claim of an employee who suffered back injuries in an accident at work.

The client worked at an airport as part of the ground maintenance team. He was required to move a large generator on wheels. He could not get a vehicle close to it due to the way another large piece of equipment had been positioned blocking access, and so he tried to manoeuvre it by hand with the help of a colleague. As he did so, the wheels locked solidly, and he fell backwards. He tried to carry on working but had to stop due to the increasing pain. 

The accident was the fault of the employer because they failed to undertake a risk assessment of the manual handling that our client was required to do. Had the risk been assessed it would have been obvious that there was a risk of injury to the client.

In the negotiations, issues included when, but for the accident, the client might have been able to continue working. He had some degenerative changes in his spine which were not due to the accident.

It is very common for people to have these changes without any symptoms and in this case, he had been able to work. We argued that he loved his work and had every reason to work beyond normal retirement. This helped in the negotiations to achieve a reasonable settlement of the claim.
