Settlement for Fractured Finger Injured in Machine at Work
This case study is a typical example of the sort of injuries that can happen in factories up and down the land.
The Claimant was working on a chicken plucking machine used to remove the feathers of chickens. Whilst working on the machine the electric display panel indicated an error. The Claimant and his colleague investigated the cause of the problem. The colleague switched off the motor and the Claimant opened the cover. However, there was another motor, which was still running. The Claimant needed to remove a belt inside the machine. As he did so, his left little finger got caught by the roller attached to the motor which was still running. As a result, the Claimant’s left little finger was fractured.
The Claimant had not been trained or instructed to switch off all other motors surrounding the motor displaying a fault/error when inspecting it and there was no sensor that would have shut down the other motor when the cover was opened.
The main reason why the employer was to blame was that they had failed to prevent access to a dangerous moving part of machinery – this has been a well-established principle of health and safety at work for years and yet these accidents keep happening.
A claim was submitted on behalf of our client and very quickly the employer admitted liability. A medical report was obtained, and the claim was settled without the need to go to court.
