Settlement reached after Defendants blamed each other

Our client worked on a recycling site and had to work on a platform to clean a trommel which was clogged with rubbish. He was not given a suitable tool and had to pull on the rubbish by hand to unblock the trommel. Suddenly, a cable that was jammed in the trommel gave way and he fell from the platform and suffered injury. This was an inherently dangerous system of work and whoever devised it was likely to be found liable if the case went to court.

Our client was working for an outsourcing company who supplied his labour to the recycling company. He was on the site of the recycling company, under their direction and control, but that was disputed. Both companies alleged that our client was under the control and management of the other.
In this situation, the claim had to be submitted in turn to both parties to see who will hold their hand up and agree to deal with the claim. Frequently, each company blames the other, as happened in this case leaving the Claimant little option but to take both to court. There may be a contractual agreement in place between the companies as to who is responsible, but that does not seem to deter some defendants in trying to pass on the blame.
In this case, after proceedings were issued, the outsourcing company agreed to settle.
