Levenes Settle Claim Against Client’s Previous Solicitors

We are quite often asked to review cases for clients who have had other solicitors acting for them. Sometimes we take over the case and see it to a successful conclusion. In one case recently, we had to bring a claim against the previous solicitor for their negligence.

What are the rules of witness statement?

Our client, Kinga Stojanow, was injured in a road traffic accident. She instructed a firm of solicitors called True Solicitors. They were not able to settle the claim and so they started court proceedings. When the case came to Trial, the judge noted that Ms Stojanow’s statement had been made in English but when she came to give evidence, her English was not good enough. On that occasion, the judge was sympathetic. He adjourned the case so that Ms Stojanow could make a statement in her native Polish. The solicitors had a lucky escape on this occasion. The judge could easily have struck out the case there and then. The Civil Procedure Rules are clear- witnesses must make statements in their own language.

What to do if a solicitor is negligent?

When the case came back to court again, True Solicitors had not learned their lesson. The court ruled on this occasion that Ms Stojanow’s statement was defective, and he struck out the case.

Ms Stojanow had lost her original case through no fault of her own.

We were able to put forward a new claim – a claim against True Solicitors for negligence. As a result of their negligence, Ms Stojanow’s case was lost. They were liable for the loss of her chance to win her case at court. They recognised their error, and it was relatively easy to agree with them the value of the claim after some negotiations and Ms Stojanow was compensated after all.
