At the time of the accident Mr RS was living and working in the UK. He intended to remain living for an indefinite period in the UK. However, due to his injuries, two years after the accident, he was forced to return to his native Poland as he was unable to cope with his job and obtained an alternative employment. Due to his financial hardship, we assisted our client in obtaining interim payments.
The defendant’s solicitors argued that Mr RS contributed to the extent of his injuries by not wearing a helmet and lack of visible clothing. Our argument was that the helmet would not have given protection against the type of head injury he suffered and as the accident had occurred in daylight, the lack of visible clothing was irrelevant.
Court proceedings were commenced and Levenes were able to secure £50,000 for Mr RS which compensated him for his injuries, loss of earnings and other financial losses.
