E-bike compensation claim against car

Levenes Solicitors have settled a claim after the Police failed to get all details following a collision between an E-bike rider and a car.

Our client was cycling on an e-bike in a cycle lane. Motor traffic alongside her was stationary in a queue.

The client was passing the stationary vehicles on the approach to a petrol filling station on her left. As she got to the entrance, a car coming from the other way, turned right into a gap in the queue and hit our client.

The police were not able to identify the driver at first, though apparently, he did not flee the scene. Unfortunately, the police did not do the very basics:

  1. Reviewing CCTV, and
  2. Taking details of witnesses or the driver.

We were able to obtain details from a witness in the queue who, amazingly, had memorised the vehicle registration and gave our client her details.

We were able to contact the witness and that enabled us to obtain the driver’s details. Ultimately, we were able to settle the claim against the insurers of the driver who caused the collision.

It was fortunate for the client that it was possible to obtain the driver’s details in this way. She was not able to get the details at the scene due to her injuries.

The police did not have the driver’s details and but for the witness doing their civic duty, it would not have been possible to make the claim against the driver’s insurance.

Anyone at the scene, and there must have been quite a few witnesses, might assume that the police obtained all details, but sadly, that is not always the case.

In this case, thankfully, there was someone on hand who was helpful to our client but many people, sadly, can be indifferent and do not want to get involved.

What should I do if I am involved in a road traffic collision?

After an accident, we recommend that you get all details of other parties, and witnesses wherever possible.

The following are the key points:

  • Call the police.
  • Get a note of the vehicle registration of the other vehicle or vehicles. Use your phone to take pictures.
  • Note down the make, model and colour of the vehicles involved in the accident or take pictures of them if you can.
  • Note the date and time.
  • Make a note of the driving conditions, weather, the position of street lighting, and other details like road markings, the position of any potholes etc.
  • Look around you, are there CCTV cameras that may have captured the collision? You may need to contact the council if they are public owned cameras or the private owner if the camera belongs to a private individual. CCTV evidence may be very helpful.
  • Note the position of damage done to other vehicles and your vehicle and take pictures if you can.
  • Take as many pictures as you can to show the positions of the vehicles and damage.
  • If you do not have a phone to hand draw a sketch.
