Multi-million pound personal injury settlement

Levenes have settled the claim of a very severely brain injured man for £11m.

Levenes acted for the young man who was a passenger in a car being driven to work by his colleague when the driver failed to stop at a crossroads and drove into the path of a lorry.

A catastrophic injury case

As a result of the collision, another passenger was killed, and our client suffered a very severe brain injury.

Our client was a Romanian agricultural worker who had not been in the country long. He was treated in hospital for his very severe injuries but due to the profound damage to his brain, he has not been able to regain the power of speech or be able to walk and is now almost completely confined to a wheelchair.

Levenes arranged for his family to be able to fly over and stay in the UK so that they could have regular contact with him.

Treatment and rehabilitation

Levenes appointed a case manager to manage his treatment as he transformed from the acute stage to the rehabilitation phase.

After stays at various rehab centres he was moved to his current placement where he has round the clock care and where he is happy and well looked after.

Liability for the collision was admitted and interim payments were made which were used to pay for case management, therapy, and equipment he needed.

Our client was unable to make decisions for himself or manage money, a deputy was appointed by the court.

As is usual in cases of this severity, the legal teams of both parties met from time to time to discuss the case.

Levenes instructed a number of key experts to provide reports for the court on our client’s injuries and needs so that the claim could be valued based on the evidence of his needs.

An issue arose as to whether the client would return to Romania and this involved consideration of how to calculate care costs and other expenses and losses in Romania if that arose.

£11 million compensation in personal injury settlement

The parties met to seek a negotiated settlement but that did not initially succeed. Nevertheless, the insurers then made an improved offer. This was considered with the assistance of a specialist financial adviser and Leading Counsel and following on from that, it was possible to agree settlement.

As the client was not able to decide if the offer should be accepted, the court was asked to approve the settlement which it did. The settlement is sufficient to fund the client’s needs for life whether or not he stays in the UK or returns to Romania.
