Accident Abroad – Building Collapses
British citizens who are injured when buildings collapse when they are abroad can make claims for compensation.
Generally, the claim must be made in the country where the incident occurred. If the injured person is abroad as part of a package, and the collapse was at a hotel that was part of the package then the tour operator is liable.
Thankfully, such cases are rare because although accidents sometimes happen at these hotels, package tour operators generally make sure that the hotels they use adhere to basic standards.
However, where holidaymakers are visiting premises outside of their accommodation, such as restaurants or nightclubs, then this is probably not part of the package.
The recent tragic collapse of a restaurant in Mallorca, is one example. This very sad case is not an isolated incident. Nightclubs and discos are businesses where tragedies occur due to overcrowding, poor building maintenance or failure to adhere to fire regulations.
In these cases, the injured parties can make a claim, but the claim has to be made in the country where the incident occurred.
