Amputation claim – accident at work
Levenes Solicitors have settled a claim for substantial damages for a factory worker who suffered a mutilating hand injury which occurred when he was trying to undertake some maintenance on a machine.
Our client worked for a furniture manufacturer. His duties included operating machinery and sorting out any problems. There were often problems when fibres would wrap around parts of the machine and stop them from working. Our client used a knife to cut away most of the fibre but some of it was still in the machine. Therefore, he started the machine, to see if the remaining fibres would be ejected by the machine. He was able to start the machine despite a protective cover having been removed. He caught his hand in a moving part of machine and lost part of his hand.
The basis of the claim was that it was possible to operate the machine without any protective covers in place. The law is clear, it should not be possible for employees’ hands to come in to contact with dangerous moving parts of machinery.
Liability was denied, our client was blamed for causing the accident himself.
Levenes Solicitors argued that it was the employer’s responsibility to ensure that the machine could not be operated in a way that created a risk of an operator’s hand being caught by moving parts.
Furthermore, after the accident, the employer made a number of changes to the machine so that this sort of injury could not occur again. It was surprising therefore that they disputed liability.
Proceedings were issued in the High Court and soon after that, the employer’s offered a settlement which was agreed.
The settlement will enable the Claimant to have treatment and cosmetic prosthetics to cover up his disfigured hand.
