Settlement of £135,000.00 after previous solicitors turned down the case

The Claimant contacted Levenes Solicitors after his initial solicitors turned down the case on the basis of an alleged letter the Claimant had written to his employer to apologise for the accident and admit fault.

This was a letter written by the employer on behalf of our client in a very apologetic tone which we felt had no merit and was very unlikely to be found to be lawful by the trial judge.

Our client was an experienced carpenter who was working at his employer’s home address while renovating his property. On the day of the accident, he was required to remove old wooden floorboards, refinish them and re-lay them.

Our client received a circular saw but did not have a workbench, and since there was no workbench available, he was told to cut the floorboards on the floor.

The circular saw had a protective guard over the blade. However, the shield did not spring back and remained in the raised position.

The Claimant was cutting a floorboard which was 1 meter long and 12 cm wide. He placed one end of the board on the floor. In his left hand he held the end of the board he was about to cut, and in his right, he operated a circular saw. While cutting, the saw hit a small nail in the board.

Amputation compensation claims

The circular saw bounced off and severed our client’s left index and middle fingers. The index finger was amputated on site and could not be saved, and the middle finger was surgically attempted but failed and surgical amputation was recommended.

The amputation was scheduled to take place on the NHS, but appointments were repeatedly cancelled. We provided support to our client who was fired from his job and was unable to secure accommodation. An application for interim payment was made and our client was able to have his middle finger amputated by one of the most experienced surgeons at a private clinic in central London, following the completion of private hand therapy sessions.

The case was incorrectly submitted by previous solicitors on the Ministry of Justice website for a claim limited to £25,000.00.

After Levenes commenced proceedings, the defendants made an initial offer of £25,875.00 plus £10,000.00 for surgery. A further offer of £97,000 was received and the case was eventually settled for £135,000.00.

The client was extremely happy with the result.
