£48,000.00 settlement for a skip lorry driver despite denial of liability

The Claimant was employed as a skip lorry driver responsible for delivering and collecting skips.

He drove to a site to collect a skip. Upon his arrival at the site, he was informed by the Defendant’s Manager that the skip was not ready yet. Therefore, the Claimant parked his skip lorry near the skip and waited behind the security fence whilst the Defendant’s dumper truck driver continued to load the skip to be ready for the Claimant’s collection.

The Claimant was aware that the dumper truck was a few metres behind him. Suddenly and without any warning, the dumper driver made a sudden manoeuvre with the dumper, catching the Claimant between the dumper and the loaded skip causing our client internal injuries. As a result, he needed to undergo laparotomy with sigmoid colectomy and a primary anastomosis. He subsequently developed a wound infection and partial dehiscence of his anterior abdominal wound. He also suffered with post-traumatic stress disorder.

The Defendant said that whilst the dumper truck was in the process of reversing away from the second skip commencing the manoeuvre forward, the Claimant took it upon himself to stand with his back to the manoeuvring dumper truck.

On both versions of events, the digger driver failed to give the Claimant any warning that he was about to move the dumper truck and that the Claimant may be at risk and provided him no opportunity to get out of the way.
