A 6-figure compensation for cyclist run over by car
Levenes have obtained a 6-figure settlement for Mr K who was knocked off his bike and then run over.
Mr K was cycling home from work when he came up behind a queue of traffic. He was attempting to overtake a car at the back of the queue when the driver of the car suddenly pulled to the right across his path. The driver was intending to turn right on to a private drive. As a result of the impact, Mr K was knocked to the ground and then dragged along under the car until the driver came to a stop.

The accident was the fault of the car driver by failing to check her mirrors and blind spot as she pulled out. She gave no thought to the possibility that there might be a cyclist overtaking her.
The car driver’s insurers never admitted liability but agreed to deal with the claim.
Mr K suffered a nasty pelvic fracture which required surgery. He was off work for over a year but was then able to return to work on light duties.
As part of the claim process, the claimant was assisted by a case manager.
One of the spin offs from making a claim, especially in cases of serious injuries, is that there is mutual interest between the claimant and the insurance company in trying to maximise the recovery of the claimant. And so, in this case, a joint independent rehab assessment was done. The insurers then paid for private treatment, which, during the pandemic, was not easy to get on the NHS.

In this case, although liability was not admitted, it was still possible to proceed with the case and secure a settlement. In some cases, insurers, for whatever reason, do not admit liability. It was not necessary to go to court, however, because the insurers took a sensible view of the case and were cooperative and willing to settle.
