CCTV helps motorcyclist prove his personal injury claim

Levenes have settled a case where a taxi driver reversed his car into a motorcyclist knocking him off his motorbike and causing him injury.

The motorcyclist had been following the taxi. The taxi driver then pulled up. The motorcyclist could not overtake at that point because of oncoming traffic in the other lane. Suddenly, and for no good reason, the taxi driver reversed his car. The motorcyclist started backing himself as fast as he could, but the car did not stop and instead hit his motorbike.

The collision occurred at slow speed but was forceful enough to knock the motorcyclist from his motorbike, run over the front wheel of the motorbike and smash the rear window of the car, which was an estate type vehicle.

Bizarrely, the taxi driver later alleged that the collision was so light it could not have caused injury and he even suggested that the window of the car had not been damaged in the collision, but some men had arrived at the scene after the collision and punched the window to break it.

Luckily, the collision occurred outside a shop and the owner of the shop had a CCTV camera pointing in exactly the right direction. The motorcyclist was able to obtain the footage, which clearly showed that his account of what happened was accurate. There were no mysterious men who appeared to break the window of the taxi. You could also see the broken glass in the road after the taxi driver had driven his car forward.

This case illustrates just how important CCTV can be. Without the CCTV, this was a case of the word of one man against another as there were no independent witnesses.
