Accident Abroad – Building Collapses

Can you claim for injuries when a car is used as a weapon?
This was illustrated by another recent case arising from the 2023 Nottingham attacks, when Valdo Calocane fatally stabbed 2 university students before also fatally stabbing a school caretaker. He then stole the school caretaker’s van and used it as a weapon, causing injury to 3 people including one man whom Levenes Solicitors represented. Calocane was charged with 3 counts of murder and 3 of attempted murder but controversially, was convicted of manslaughter on the grounds of diminished responsibility.

This case illustrates just how important CCTV can be. Without the CCTV, this was a case of the word of one man against another as there were no independent witnesses. Without that evidence, the Claimant risked being accused of dishonesty which insurers are very quick to allege in low-speed collisions.

On both versions of events, the digger driver failed to give the Claimant any warning that he was about to move the dumper truck and that the Claimant may be at risk and provided him no opportunity to get out of the way. Therefore, we issued court proceedings and although liability was in dispute, Levenes were able to obtain £48,000.00 for the Claimant’s injuries and losses. £15,000.00 compensation after police unlawful entry to house
After the issue of proceedings, the police offered £1,000.00 which was simply a nominal offer for the unlawful entry and wanted the Claimant to see their psychiatrist. Levenes argued that they were prolonging the Claimant’s recovery from her injuries by refusing to accept her case and by putting her through the ordeal of reliving her experience again with their psychiatrist.
